Introduction

These terms and conditions govern your use of the Travel Mapper (as listed in the Google Marketplace) (the "App"); by using this App, you accept these terms and conditions in full. If you disagree with these terms and conditions or any part of these terms and conditions, you must not use this App. You must be at least 18 years of age to use this App. By using this App, and by agreeing to these terms and conditions, you warrant and represent that you are at least 18 years of age. This App uses collects personal information. By using this App and agreeing to these terms and conditions, you consent to our use collection of personal information in accordance with the terms of privacy policy. License to use App

Unless otherwise stated, Travel Mapper and/or its licensors own the intellectual property rights in the App and material on the App. Subject to the license below, all these intellectual property rights are reserved. You may view, download for caching purposes only, and print pages from the App for your own personal use, subject to the restrictions set out below and elsewhere in these terms and conditions. You must not: - republish material from this App (including republication on another website); - sell, rent or sub-license material from the App; - show any material from the App in public; - reproduce, duplicate, copy or otherwise exploit material on this App for a commercial purpose;

Acceptable use

You must not use this App in any way that causes, or may cause, damage to the App or impairment of the availability or accessibility of the App; or in any way which is unlawful, illegal, fraudulent or harmful, or in connection with any unlawful, illegal, fraudulent or harmful purpose or activity.

You must not use this App to copy, store, host, transmit, send, use, publish or distribute any material which consists of (or is linked to) any spyware, computer virus, Trojan horse, worm, keystroke logger, rootkit or other malicious computer software.

You must not conduct any systematic or automated data collection activities (including without limitation scraping, data mining, data extraction and data harvesting) on or in relation to this website without Travel Mapper's express written consent.

You must not use this website for any purposes related to marketing without Travel Mapper's express written consent.

User content

In these terms and conditions, “your user content” means material (including without limitation text, images, audio material, video material and audio-visual material) that you submit to this App, for whatever purpose. You grant to Travel Mapper a worldwide, irrevocable, non-exclusive, royalty-free license to use, reproduce, adapt, publish, translate and distribute your user content in any existing or future media. You also grant to Travel Mapper the right to sub-license these rights, and the right to bring an action for infringement of these rights. Your user content must not be illegal or unlawful, must not infringe any third party’s legal rights, and must not be capable of giving rise to legal action whether against you or Travel Mapper or a third party (in each case under any applicable law). You must not submit any user content to the App that is or has ever been the subject of any threatened or actual legal proceedings or other similar complaint. Travel Mapper reserves the right to edit or remove any material submitted to this App, or stored on our servers, or hosted or published upon this App.

No warranties

This App is provided “as is” without any representations or warranties, express or implied. Travel Mapper makes no representations or warranties in relation to this App or the information and materials provided on this App. Without prejudice to the generality of the foregoing paragraph, Travel Mapper does not warrant that: – this App will be constantly available, or available at all; or – the information on this App is complete, true, accurate or non-misleading. Nothing on this App constitutes, or is meant to constitute, advice of any kind.

Limitations of liability

The App will not be liable to you (whether under the law of contact, the law of torts or otherwise) in relation to the contents of, or use of, or otherwise in connection with, this App: – to the extent that the App is provided free-of-charge, for any direct loss; – for any indirect, special or consequential loss; or – for any business losses, loss of revenue, income, profits or anticipated savings, loss of contracts or business relationships, loss of reputation or goodwill, or loss or corruption of information or data. These limitations of liability apply even if the App has been expressly advised of the potential loss.

Exceptions

Nothing in this App disclaimer will exclude or limit any warranty implied by law that it would be unlawful to exclude or limit; and nothing in this App disclaimer will exclude or limit the App liability in respect of any: – death or personal injury caused by Travel Mapper negligence; – fraud or fraudulent misrepresentation on the part of Travel Mapper; or – matter which it would be illegal or unlawful for Travel Mapper to exclude or limit, or to attempt or purport to exclude or limit, its liability.

Reasonableness

By using this App, you agree that the exclusions and limitations of liability set out in this website disclaimer are reasonable. If you do not think they are reasonable, you must not use this App.

Unenforceable provisions

If any provision of this App disclaimer is, or is found to be, unenforceable under applicable law, that will not affect the enforceability of the other provisions of this App disclaimer.

Indemnity

You hereby indemnify the App and undertake to keep the App indemnified against any losses, damages, costs, liabilities and expenses (including without limitation legal expenses and any amounts paid by the App to a third party in settlement of a claim or dispute on the advice of the App’s legal advisers) incurred or suffered by the App arising out of any breach by you of any provision of these terms and conditions.

Breaches of these terms and conditions

Without prejudice to the App’s other rights under these terms and conditions, if you breach these terms and conditions in any way, the App may take such action as the App deems appropriate to deal with the breach, including suspending your access to the App, prohibiting you from accessing the App, blocking computers using your IP address from accessing the website, contacting your internet service provider to request that they block your access to the website and/or bringing court proceedings against you.

Variation

The App may revise these terms and conditions from time-to-time. Revised terms and conditions will apply to the use of this website from the date of the publication of the revised terms and conditions on this website. Assignment

These terms and conditions will be construed in accordance with and governed by the laws of the United States and the State of Florida, without reference to their rules regarding conflicts of law, and any disputes relating to these terms and conditions will be subject to the exclusive jurisdiction of the courts of the state of Florida.

Refunds and Cancellations

At Travel Mapper, we offer a basic itinerary template that is always free to use. For paid plans, we offer a 7-day free trial of all premium features after installation. If you choose to upgrade to a paid plan, you will be charged in advance on a recurring basis, depending on the subscription you choose.

We understand that circumstances may change and you may wish to cancel your subscription or request a refund. Here are our policies regarding refunds and plan changes:

– Cancellation: You can cancel your subscription at any time. If you cancel during your free trial, you will not be charged. If you cancel after your free trial, your account will be accessible until the end of the billing cycle. No further charges will be made after cancellation.

– Refunds: We offer a 14-day money-back guarantee for our paid plans. If you are not satisfied with our product within 14 days of your purchase, please contact admin@blueplanit.co to request a refund. Refunds apply to subscription purchases or renewals. We may ask for feedback to understand how we can improve our product for future customers.

Blue Planit LLC Affiliate Program Terms and Conditions

These Affiliate Program Terms and Conditions ("Terms") govern your participation in the Blue Planit LLC Affiliate Program ("Program") offered by Blue Planit LLC ("Company"). By enrolling in the Affiliate Program, you are bound by these Terms. We strongly recommend reviewing these Terms thoroughly before becoming a member of our Program.

Enrollment in the Program

1.1 Eligibility: To be eligible for the Program, you must be at least 18 years old and have the legal authority to enter into a binding agreement. Companies, organizations, and individuals are welcome to participate. Accounts registered using automations (e.g. by bots or other means) are not permitted.

1.2 Registration: To enroll in the Program, you must complete the affiliate registration form available on our website. We reserve the right to accept or reject any affiliate application at our sole discretion.

Affiliate Responsibilities

2.2 Compliance: You shall adhere to all applicable laws, regulations, and ethical guidelines in your promotion of Blue Planit LLC. This includes, but is not limited to, complying with anti-spam laws, privacy laws, and intellectual property rights.

2.3 Accurate Representation: When promoting Blue Planit LLC, you must accurately represent the Company and its offerings. You may not engage in any deceptive, misleading, or fraudulent practices that could damage the Company's reputation.

2.4 Prohibited Activities: You shall not engage in any activities that could harm Blue Planit LLC, its customers, or affiliates.

Commission Structure and Payment

3.1 Commission Rates: The details of applicable commission rates can be found on your dashboard once you register for the program. These rates are subject to change at the Company's discretion and will be communicated to you in advance.

3.2 Qualified Referrals: A qualified referral is a customer who signs up for a paid subscription to Blue Planit LLC using your unique referral link or referral code. Only qualified referrals are eligible for commission payouts.

Term and Termination

4.1 Term: These Terms will remain in effect until terminated by either party. You may terminate your participation in the Program at any time by providing written notice to the Company.

Intellectual Property

5.1 Limited License: The Company grants you a non-exclusive, non-transferable, revocable license to use its logos, trademarks, and promotional materials solely for the purpose of promoting Blue Planit LLC as an affiliate.

5.2 Intellectual Property Rights: You acknowledge that all intellectual property rights in Blue Planit LLC, its trademarks, and associated materials belong to the Company. You shall not modify, reproduce, or distribute any of these materials without the Company's prior written consent.

Limitation of Liability

6.1 No Warranty: The Company provides no warranty or representation regarding the Program, its availability, or the accuracy and completeness of the tracking and reporting systems. The Program is provided on an "as is" basis.

6.2 Limitation of Liability: In no event shall the Company be liable for any indirect, consequential, or special damages arising out of or in connection with the Program.

General Provisions

7.1 Modification: The Company reserves the right to modify these Terms at any time. Any modifications will be republished on your affiliate dashboard with an updated date.

By joining Blue Planit LLC Affiliate Program, you acknowledge that you have read, understood, and agree to be bound by these Affiliate Program Terms and Conditions.
